The ,Sheriff is not a hireling of the governor; your sheriff is not a hireling of the County; nor is your sheriff at the mercy of the mayor…. Your sheriff is a constitutional officer with unique responsibility, because your Sheriff is the highest executive authority in your county. Your Sheriff outranks the governor; he outranks the county; he outranks the city; He outranks the President of the United States.… He outranks the ATF; he outranks the EPA; he outranks the Department of the Interior; he outranks the FDA, the USDA. He outranks them all. There is no agent in Federal or State government that has the authority to exercise any power in your county without first obtaining your Sheriff’s permission. –,Krisanne Hall, JD

So if the Sheriff is so powerful, how is he kept in check?

He is sworn to uphold the State and U.S. Constitution; he answers directly to the American people; and he gets paid by the People of his county.

According to ,Mike Herrington, Chaves County, NM, “The Sheriffs ONLY report to the American people; the Sheriffs ONLY report to the voters; The People are our ONLY supervisors.… Nobody is my supervisor except the People. That’s why we’re a constitutional republic- where the people choose their public servants, not other bureaucrats, not a king and not some other oligarchy.”

I am grateful that our Sheriffs are elected constitutional officers sworn to uphold the State and U.S. Constitutions whereby they promise to secure our life, liberty and property. It is not the job of our Sheriffs- or any other peace officer, county commissioner or Governor, for that matter, to enforce UNConstitutional laws. In fact, they have a duty to refuse.

There are two important ways we can begin to defend our God-given rights and liberties. We can get in touch with our own County Sheriff. We can encourage him and get involved. Let him know that we want to support a constitutional Sheriff. We can put together community meetings with our Sheriff so that we can unite with him and other patriots. The Sheriff is our best defense against the infringement of our tyrannical Governor who has mandated illegal, unconstitutional orders in Colorado. Since the Governor is part of the executive branch, his job is to enforce constitutional laws made by the legislative branch. The Governor does not have the authority to legislate and he does not have the authority to mandate criminal orders; he may enact civil laws. However, civil laws have no real teeth- no one can be legally arrested, fined or jailed.

The ,CSPOA is also an important organization, founded by Richard Mack,which consists of Sheriffs, Peace Officers, Military, Veterans, elected officials and citizens dedicated to upholding their oaths to protect the constitutional liberties of the people.” Anyone can join and help to assemble people in the cause of protecting, upholding, defending, preserving and obeying the U.S. Declaration of Independence, the U.S. Constitution and the Bill of Rights.

 

Even when We the People might be convinced that our safety and security is at stake, we must remember that each of us is responsible for our own safety and security. We allow the government to govern us only in as much as they obey our constitution which protects our rights and liberties given to us by our Creator. Let’s stand with our Sheriffs who have the power to restore our liberties which we have already complacently given up. Let’s not wait until they are our last stand.

 

In Printz vs. the United States, the Supreme Court, 1997, Supreme Court Justice Antonin Scalia stated in the ruling:

But the Constitution protects us from our own best intentions: It divides power among sovereigns and among branches of government precisely so that we may resist the temptation to concentrate power in one location as an expedient solution to the crisis of the day.” ,505U.S., at 187,,.

 

We the people are those sovereigns and we may be tempted to allow the Governor to act as king- allowing him to have the power of both executive and legislator. Today, the crisis of the day is the coronavirus.We cannot allow our rogue officials to so blantantly misuse their power corruptly.
